FAMILY, ALGORITHMS, AND FUNDAMENTAL RIGHTS: SCENARIOS, TRENDS, AND MEGATRENDS

Abstract

This research investigates the relationship between family, algorithms, and fundamental rights in the context of contemporary digital transformation, marked by the intensified use of automated systems in social, economic, and institutional life. It starts from the recognition that, in Brazil, the accelerated incorporation of digital technologies into public policies, the justice system, and private relationships has produced tensions between innovation, privacy, human dignity, and family protection, especially in the face of social inequalities and the increasing use of personal data in sensitive contexts. The general objective of the research is to critically analyze the impacts of artificial intelligence and the processing of personal data on family relationships in light of fundamental rights, with an emphasis on intimacy, privacy, and human dignity. As specific objectives, it seeks to examine the constitutional and infraconstitutional framework applicable to the protection of personal data and private life within the family context, as well as to investigate how algorithmic systems influence family dynamics, asset management, and digital inheritance. Methodologically, a hybrid approach is adopted, of a bibliographic, documentary, historical, and jurisprudential nature, with a systematic review of academic literature, legislation, and judicial decisions related to the central descriptors of the research. It is expected to conclude that the use of algorithms in the field of family relations, without adequate regulation and control, can deepen vulnerabilities and violate fundamental rights, requiring the formulation of legal and interpretative parameters capable of ensuring human supervision, data protection, social justice, and effective protection of family plurality in the digital society.
