Abstract

This article examines patent protection in the Brazilian legal system from the perspective of the 1988 Federal Constitution, investigating the reconciliation between the inventor's legal certainty and the social function of industrial property. The core problem is to determine how to harmonize temporary exclusivity with the protection of public interests, such as public health and free competition. Adopting a deductive method based on bibliographic, documentary, and case-law research, emphasizing ADI 5,529/DF, REsp 1,543.826/RJ, and the compulsory licensing of Efavirenz, it is argued that the social function is an inherent element of the constitutional legitimacy of patent protection. The conclusion is that legal certainty requires predictable protection for inventors without turning exclusivity into an absolute right, and any State intervention must comply with legality, reasoning, and proportionality.
