Abstract

The study addresses education within the Brazilian prison system as an instrument for resocialization and sentence remission, situated in a context marked by prison overcrowding, high recidivism rates, and structural deficiencies in penal execution. Considering the need to ensure the effectiveness of human rights and to promote more humane public policies, it problematizes the insufficient access to education in prisons and its repercussions on the social reintegration of incarcerated individuals. The objective is to analyze sentence remission through education in the Brazilian penal system, examining its legal foundations, practical application, and impacts on reducing recidivism and fostering the reintegration of individuals deprived of liberty. To this end, a qualitative, exploratory study was conducted, based on bibliographic and documentary research, grounded in legislation, legal doctrine, and academic studies relevant to the theme. Thus, it is observed that prison education constitutes a significant instrument of social transformation, as it enables the acquisition of knowledge, the development of self-esteem, and the construction of new life perspectives, in addition to contributing to the reduction of criminal recidivism and to the rationalization of the penal system. However, significant obstacles are identified, such as structural precariousness, scarcity of resources, and the persistence of social stigma, which limit the effectiveness of this policy. This allows the conclusion that, although sentence remission through education represents a relevant normative advancement, its consolidation as an effective instrument of resocialization depends on the strengthening of educational policies within prisons, ensuring universal access, continuity in education, and integration with broader strategies of social reintegration.
